CRTC requests meeting with Rogers regarding net neutrality

The CRTC has requested a meeting with Rogers Communications Inc. after discovering another potential breach of the net neutrality rules in the company’s Internet throttling practices. In a letter to the company Wednesday, Andrea Rosen, the commission’s chief compliance and enforcement officer, said CRTC testing concluded that Rogers throttled unidentified upload traffic in contravention of commission rules. Though Rogers’ throttling policy states the company’s intention to throttle upstream traffic from Internet ports associated with peer-to-peer (p2p) file-sharing, the commission’s tests found Rogers throttled unidentified traffic “regardless of the port used, when traffic from certain popular P2P applications is or was recently present,” Rosen said. She wrote that time-sensitive traffic may also be throttled and that “consumers may be adversely affected in these circumstances.” The CRTC told Rogers in January it believed the company had violated the net neutrality rules for throttling unidentified traffic from p2p ports after the Canadian Gamers Organization launched complaints against the company last year. Rogers responded in February with an announcement that it had fixed the problem and that network upgrades would allow the company to stop its traffic management practices altogether by the end of 2012. Rosen said the commission appreciated the company’s quick response to the previous issue and asked to meet with Ken Engelhart, Rogers’ senior vice-president of regulatory affairs, to discuss the new problem. “While we note Rogers’ intention to phase out its traffic shaping policy by December 2012, this issue appears to be an instance of non-compliance, and thus requires immediate attention,” Rosen wrote. “Further, in the interest of ensuring that the December 2012 phase-out addresses any potential issues in the future, we invite Rogers to also provide the details on this initiative and its rollout.”
