Rogers seeks Saint John MDU access in CRTC complaint

Rogers Communications Inc. filed a Part 1 application with the CRTC asking the regulator to help it get access to a number of apartment complexes in Saint John, N.B., in another dispute involving a multi-dwelling unit (MDU). In the application filed with the regulator May 6, Rogers wrote that it was given access to the first two buildings in a four-building development, after which the developer said he was "satisfied with only having one service provider (BCE Inc.) in these properties." The developer persisted in denying Rogers access to the building despite being advised of CRTC rules requiring developers to provide access to their properties, Rogers' complaint continues. The same developer then stopped responding to Rogers requests for access to a separate development in Saint John, the company's Part 1 said. According to Rogers, the CRTC should act on the complaint within the next month. "It is Rogers’ understanding that the installation of wiring and other facilities in the property by Bell has already taken place or will soon take place within the next 30 days," Rogers wrote in the complaint. "As a result, it is imperative for the Commission to issue a determination within this timeframe, on an expedited basis, such that we can obtain access to the Property during the construction period," Rogers wrote. Rogers is thus asking the CRTC to give the developer and other interested parties 10 days to file comments on Rogers' proposal. According to the complaint, the developer, Iron Gate Developments, repeatedly asked for payments of $50,000 and $100,000 from Rogers in exchange for access to the properties. Rogers said that the developer has also sought to get other Saint John developers to deny the company similar access to other properties in the city. "Iron Gate’s refusal to provide Rogers with access is harming the residents’ right to choose from among different service providers on the date of occupancy and realize the full benefits of competition," Rogers wrote in the CRTC filing. "For Rogers to compete on a level playing field with Bell and other service providers, we need access to MDUs during construction to install our facilities and operate our telecommunications network so that we are in a position to provide residents with access to all of our products and services upon the date of occupancy."
