Rogers renews request to CRTC for building access in N.B.

Rogers Communications Inc. is repeating its request that the CRTC help it gain access to a number of apartment complexes in Saint John, N.B., as it claims it has not heard from the developer following its Part 1 application. Rogers said in a reply last week to its own application, filed with the CRTC May 6, that an expedited ruling is necessary so it can access Iron Gate Development’s multi-dwelling unit (MDU) project while it is under construction in order for its services to be an available option once residents move in. “It will also provide us with the ability to access Iron Gate’s future MDU developments for purposes of installing, operating, maintaining and replacing transmission facilities and ancillary telecommunications equipment,” the company said in its reply dated May 25. Rogers claims in its original application the developer gave it access to the first two buildings in a four-building development, the repeatedly asked for payments of $50,000 and $100,000 in exchange for access. After Rogers accessed the first two, the developer told the company he was “satisfied with only having one service provider (BCE Inc.) in these properties,” according to the application. Rogers claims the developer continued to deny it access even after being advised of CRTC rules requiring developers to provide access to their properties. It said that the same developer then stopped responding to its requests for access to a separate development in Saint John. “By issuing a determination on an expedited basis, the Commission would enable Rogers to obtain access to the MDU development known as Telegraph Square (the Property) and to future MDU developments of Iron Gate in Saint John, New Brunswick on reasonable terms and conditions,” Rogers wrote in its recent reply signed by its vice president, regulatory, Pamela Dinsmore. Earlier this month, Rogers said it was of the understanding that Bell has already installed wiring and other facilities in the property or would over the next 30 days as it requested an expedited determination by the commission. The company asked in its original filing that the CRTC act within a month and that it give the developer and other interested parties 10 days to file comments. The reply by Rogers is the only one available on the commission’s website and the company said in its reply it has not heard from any other parties. Adding to its claim, Rogers said in its application the developer has attempted to get other developers in Saint John to deny it access to other properties around the city. “For Rogers to compete on a level playing field with Bell and other service providers, we need access to MDUs during construction to install our facilities and operate our telecommunications network so that we are in a position to provide residents with access to all of our products and services upon the date of occupancy,” it said in its application.
