Rogers claims Saint John developer ignoring CRTC proceeding

In its ongoing effort to gain access to multiple apartment buildings in Saint John, N.B., Rogers Communications Inc. said in a reply filed with the CRTC Tuesday that a representative of IronGate Developments has not officially responded to its application. The developer’s inaction is “only part of a repeated pattern of bad faith conduct by Mr. (Stephen) Brittain -- who has continued to ignore Rogers’ numerous attempts to contact him,” Rogers said in a reply signed by Pamela Dinsmore, the company’s regulatory vice president, and filed with the CRTC Tuesday. Rogers has been trying to get into IronGate’s apartment buildings during the construction period for months -- filing its application in early May -- and wants an order from the commission granting it access to the buildings and any future properties that may be developed by IronGate or any company controlled by Brittain through an expedited ruling. It also wants an an order saying no other carriers may install equipment or provide services at the properties or any related future ones unless Rogers has also been granted access. Rogers claims in its original application the developer gave it access to the first two buildings in the four-building development known as Telegraph Square, then repeatedly asked for payments of $50,000 and $100,000 in exchange for access, and had stopped responding to its requests for access to a separate development in Saint John. If IronGate did file a response with the commission, it did not serve a copy to Rogers as required, the company claimed. “Despite Rogers’ best efforts to reach a cooperative agreement, IronGate has denied us any opportunity to access the Property to install our facilities during the construction phase,” as it wants to be available as a choice for residents as they move in. While Rogers requested its expedited order, BCE Inc. -- which is said to be the only provider with access to the buildings at this time, though it does not have an exclusive agreement with the developer -- suggested in a separate response to the proceeding that the CRTC use an incremental enforcement mechanism. With its reply Tuesday, Rogers included what it said is proof of delivery showing its Part 1 application was delivered to Brittain the morning of May 11, and proof showing its previous reply was delivered May 27. This is going against IronGate’s claim that it was “unaware of the proceedings until it was served with a copy of Bell’s RFI response by email,” as it said in a commission letter from July 8. Rogers said IronGate asserted that the delivery address is no longer associated with or used by IronGate, and disputed that statement.
