TekSavvy files Part 1 application over property in Chatham Ont.

TekSavvy Solutions Inc. has become the latest CLEC calling on the CRTC to help it negotiate timely access to a property. In this case, the building is at 175 Churchill Park Road in the southwestern Ontario city of Chatham. TekSavvy first approached 2767456 Ontario Inc. in December 2021 offering to provide telecom services to residents of the property firm’s multiple dwelling unit (MDU). At the end of the month the property company said it was already in negotiations with another telecom company. On Feb. 14, 2022 the numbered company told TekSavvy it would not allow access to its Churchill Park Road premises. In March of this year, TekSavvy again approached 2767456 seeking access. The property company said it would allow the telecom in but put several conditions in place. In July it laid those conditions out in an email to TekSavvy. The telecom could only access the property Monday to Friday from 7 a.m. to 2 p.m.; it would be responsible for coordinating with tenants for access to their units; TekSavvy would be permitted to make its services available; the MDU owner would protect the telecom equipment; TekSavvy would not be permitted to advertise its services in the building. Several phone calls to the numbered company from TekSavvy went unanswered. On July 21, the firm sent an email to the telecom saying the agreement stood and if TekSavvy had any complaints it should take them up with the property manager’s lawyer when he returned from holidays. “We are committed to good faith negotiations with the objective of reaching collaborative outcomes,” the telecom company wrote the commission. “However, 2767456 Ontario Inc. does not wish to sit at the negotiating table with TekSavvy, despite its obligation to do so.” The telecom is seeking the usual remedy for access. Within 15 days of a CRTC decision, no other LEC or carrier ISP on the premises will be able to take on new clients. After 30 days, they cannot upgrade current subscribers. After 45 days, no service may be provided at all.
