TekSavvy wants access to MDU building in Chatham-Kent

TekSavvy Solutions Inc. filed a Part 1 application with the CRTC requesting that a real estate development and management company give it timely access to a multi-dwelling unit (MDU) in Chatham, Ont. In a Sept. 15 application, posted to the commission website Thursday, TekSavvy alleges that Casilco Corporation is not complying with the commission’s MDU access framework which states that local exchange carriers (LECs) “wishing to serve end-users in that MDU are able to access end-users in that MDU on a timely basis, by means of resale, leased facilities or their own facilities, at their choice, under reasonable terms and conditions.” According to the company, it first requested access to the premises, located on Grand Ave. West, Chatham, in Aug. 2020. “At that time, TekSavvy’s understanding was that the MDU owner was prepared to negotiate in good faith with TekSavvy for access to the premises,” the telecom wrote. According to TekSavvy, it completed a walk-through of the premises in Oct. 2020 and provided the building owner with its technical assessment at the beginning of November. A few weeks later TekSavvy was informed that the owner was “concerned about disruptions and asked for complementary services in order to permit TekSavvy access.” TekSavvy alleges that it attempted to negotiate with the owner until Aug. 2022 and did not receive a response. Finally, in March TekSavvy requested access to the premises once more and negotiations briefly proceeded. The owner reiterated its desire for complimentary services and other benefits before TekSavvy could have access. In July the telecom provided a revised MDU agreement and has not heard “any substantive response from the MDU owner.” “Based on the history described above, TekSavvy does not believe that the MDU owner has any intention of engaging in good faith negotiations to allow TekSavvy access to the premises pursuant to terms and conditions that are just and reasonable,” TekSavvy wrote. TekSavvy is requesting the usual relief. Within 15 days following a CRTC decision on the matter, any other LEC or carrier in the premises will not be permitted to provide services to new residents or current residents that do not have service.
